ABC enters into Primary Authority Agreement

We are delighted to announce that the ABC Legal Labels food label assurance scheme now operates as part of a Primary Authority Partnership with Norfolk Trading Standards.

What this means in practice

Food labels which have been certified by us and entered into the ABC Legal Labels scheme will be accepted by local authorities in England and Wales as being compliant with food law.

Consumers can trust the information provided on such labels and food businesses who are accepted into the scheme have the reassurance that their labels are compliant with law so that they can do what they do best – concentrate on running their businesses.

What is ABC Legal Labels?

 What is Primary Authority?

Primary Authority is a statutory scheme, established by the Regulatory Enforcement and Sanctions Act 2008. It allows an eligible business to form a legally recognised partnership with a single local authority in relation to regulatory compliance. This local authority is then known as its ‘primary authority’.

ABC Food Law has established a Primary Authority Partnership with Norfolk County Council with respect to the “ABC Legal Labels” scheme. 

What can Primary Authority do for your food business?

ABC Food Law act as a “Co-ordinator” in a similar way to a Trade Association for members of the ABC Legal Labels scheme.

As such, once a food label is assessed as compliant with food law, we invite the food business to join the scheme, free of charge for the first year, whereby they automatically fall within the protection of the Primary Authority Scheme.

As such, our members can enjoy peace of mind that they will not have to face queries regarding their food labels from local authorities in England and Wales.

How much does it cost?

A detailed label assessment, against the requirements of our Technical Standard, costs £295 + vat for the first label and £95 + vat for each label submitted for review at the same time.

For this fee we provide a detailed written report including an action plan for those labels which fall short of legal requirements. We also provide up to 28 days free consultancy to help applicants meet their legal requirements.

Once a food label is confirmed by us as compliant, we issue a certificate and allow the use of our logo on the label and/or related advertisements.

How to become a member of the scheme.

To become a member of the scheme for a given product and hence benefit from the Primary Authority you must hold a valid Compliance Certificate.

Application for a Compliance Certificate requires that we firstly carry out a detailed food label review and then verify that all aspects of relevant food law have been complied with.

Once this has been done, you will be issued with a Compliance Certificate, an approval number for the label and the relevant details will be added to our public register at www.abc-legal-labels.co.uk.
